FAIR USE POLICY
Virgin Mobile India Pvt. Ltd. adopts a Fair Usage Policy (“FUP”) for the purpose of defining fair usage levels for unlimited data transfer plans. This ensures that the excessive usage of internet bandwidth by a small segment of users does not impact service quality for a large set of users.
FUP is applicable to all existing and future unlimited plans offered by VMI unless specifically withdrawn at the discretion of VMI. Taking into consideration the maximum reasonable usage required by the average user, VMI has established a monthly data transfer threshold (Fair Usage Limit) for the unlimited tariff plans as given below:
| Plan Type |
Plan Speed*
(Kbps) |
Fair Usage Limit
(MB/Month) |
| 801Plan |
Upto 153 |
10 GB/month |
*CDMA Network Speed
Upon such violation of the FUP, VMI shall contact the user suggesting for reduction in usage or upgrade to a higher bandwidth plan.
Despite the above, if the user fails to upgrade to a high speed plan and/ or continues to violate the FUP, VMI reserves the right to suspend or terminate such user’s account immediately without prejudice to other rights.
